When a child is born according to Article 19e sub 6 of the New Civil Code of the Netherlands Antilles and as amended: The obligation to make a declaration must be complied with within five (5) days of the date of the childbirth. Where no declaration is made within the five (5) days period, the Civil Registrar shall report this to the Public
Prosecution Service.
* Declaration of birth:
Article 19e sub 1 and sub 2 of the New Civil Code of the Netherlands Antilles and as amended states:
1. A mother of a child shall have the capacity to make a declaration of the birth.
2. The father has the duty of declaration.
* Short summary concerning acknowledgement:
Article 203 of the New Civil Code of the Netherlands Antilles and as amended states:
1. Acknowledgement of a child that has no father can be made;
a. by an instrument of acknowledgement prepared by a Civil Registrar;
b. by notarial instrument.
Article 204 Paragraph 1 sub e. of the New Civil Code of the Netherlands Antilles and as amended states;
*The acknowledgement is null and void, if it is made:
After the expiry of the statutory period for a declaration of the birth of a child, unless it is plausible that the man is the biological father of the child or that there is or has been a close personal relationship between the man and the child.
* Acknowledgement can also be done by a biological father of a child during the pregnancy of a mother.
